If you, as a Chinese citizen, are marrying an American citizen and got divorced before, then U.S. Citizenship and Immigration Services (USCIS, formerly Immigration and Naturalization Service - INS) asks you to submit “certified translation” of your certificate of divorce.
Certified translation of your divorce paper is requested before you apply for fiancé visa (K-1 or K-2) or marriage visa. Some immigrants bring “certificate of single” to prove that they are not currently married. However, this certificate is primarily for those who have never married before.
Courts in the United States also require certified translation of your Chinese divorce decree when you apply for marriage.

While divorce rate in China is much less than those in Western countries, it is increasing (21 percent increase in 2003) as a result of liberal divorce laws. In contrast to Western countries, father gets the custody of children in most cases as they are better economical condition than women. Divorce results in dissolving the bonds of matrimony. Legally, divorce does not make the marriage null or void but simply cancels it.
Contentious divorces are handled by courts while non-contentious divorces are resolved by civil affairs offices in China. In both cases, you need to have your divorce decree “certified” in hard copy in the United States.
